Disabled Adults
Is your family member unable to make personal or financial decisions for him or herself due to advanced age or disability? If so, you may need to have a legal guardian appointed through the court.
There are many steps necessary to obtaining and maintaining a guardianship. Guardianship is an ongoing process which begins when a Petition is filed in the proper County, with service on the disabled person and notice to the appropriate family members. Often a Guardian Ad Litem is appointed by the Court to interview the disabled person and notify them of their rights. The attorneys at WhiteheadFink Elder Law, LLC have experience representing Guardians in simple situations, as well as in complex or contested matters. We will appear in Court with the proposed guardian to complete the appointment, and assist with the ongoing process, including completing and filing the required inventory, accountings and annual reports.
Minor Guardianships
Is a minor child in need of a Guardian due to the death or unavailability of a parent? Has a child inherited a substantial sum of money which must be managed through the Court? We can guide you through the process of appointing a legal guardian for a minor. Once appointed, a Guardian can make personal or financial decisions for the minor child, as well as have custody of the minor. Minor guardianships terminate once the child reaches the age of 18. In some cases, an adult guardianship may follow.
